Protection of Private Life
The Luong and Leclerc Pharmacy Inc. ( designed as "the Pharmacy'' in this text) attaches great importance to the protection of personal information. Determined to preserve the exactitude, the confidentiality, the integrity and the security of your personal information, the Pharmacy prepared the present Code of protection of private life based on the requirements prescribed by the « Law on the protection of personal information and electronic documents » and the provincial laws with regards to protection of applicable personal information. This code comes within our commitment to see to it that the personal information in our possession be protected and be collected , used or disclosed only in conformity with the applicable laws.
What does the expression « personal information » mean ?
By « personal information » we mean all information about an identifiable person else than certain some professional coordinates. Personal information may include the person's home address, date of birth, social insurance number and financial and medical information on that person. The kind of personal information we ask you depends also on the nature of the transaction. Here are some examples of the kind of personal information we collect, use and disclose :
Details: In its store, the Pharmacy collects and uses personal information that is necessary to process your transaction such as proof of your identity, if need be. We may ask you to provide personal information when returning any products to protect the commercial activities of the Pharmacy. We may also ask you to provide information about the use of the product delivered with or without prescription
On line: When opening an account on line, the Pharmacy will ask you your name, address, e-mail address and some other personal information. We also ask for your personal information when you buy on line ( so as to be able to process your order) and when entering a contest. Should your personal information be used for other purposes, your consent must be obtained.
The 10 Principles of Confidentiality
1. Responsability
The Pharmacy is responsible of personal information under its control, particularly that transmitted to third parties for treatment or administration purposes. The Pharmacy appointed a representative ( a pharmacist ) who is in charge of the protection of private life. This person is responsible for ensuring that the Pharmacy respects the present Code of protection of private life, any other code of protection of private life that applies to you and the laws regarding the protection of private information.
2. Mention of the purposes
The Pharmacy will mention the purposes for which it collects personal information before getting that personal information or at the moment it collects it , unless the purposes are obvious. When we foresee using your personal information for a purpose that was not mentioned at the time of collecting it, we will specify that new purpose before using the information. With your consent we collect personal information for various purposes namely the following:
- to verify your identity and protect each party against any error or fraud
- to verify your eligibility to our products and services and to supply you with them
- to follow and analyse your use of products and services ( including the number of transactions by type, product code, brand, etc.) , your shopping habits and the means you use to obtain theses products and services in order to help us serve you and provide you with the information on other products and services that the Pharmacy believes may be of interest to you.
- to manage and develop the Pharmacy's activities and establishment
- to generate statistics and global reports for internal operations
- to comply with the laws and regulations
- for any other purpose mentioned in the policy of confidentiality of the Pharmacy that applies to you.
3. Agreement
The Pharmacy will not collect, use or disclose your information without your knowing it or without your consent, except when the law stipulates or authorizes it. By agreement we understand voluntary agreement to the collect, use and disclosure of personal information for specific purposes. The Pharmacy will not unreasonably request your consent to the collect, use or disclosure of information as a condition of the supply of a product or service beyond what is required in the circumstances. The way your consent is obtained may vary according to the circumstances and the type of personal information required.
The consent may be explicit ( orally or electronically or in writing ) or implicit ( given with or without action ) , it may be given directly by you or by an authorized proxy . For example, regarding some medicine, we may ask you a written consent allowing us to use your personal information in order to make direct postal shipments that can be useful for your therapy. On the other hand, when you provide us with your personal information and your prescription drug plan information for the purpose of processing insurance payment of prescription drug costs by third parties, this constitute implied consent. Furthermore, when you ask for a delivery we ask you basic information which is also an implicit consent authorizing the Pharmacy to use it so as to treat your order and do the delivery.
Refusal or withdrawal of consent
You may refuse to consent to the collect, use or continuous disclosure of your personal information, withdraw your consent , or inform us , with an appropriate notice to the Pharmacy, that you wish at no time to receive commercial information. We will do our best to accommodate you subject to any legal or contractual restrictions , current industry standards and technical abilities. The withdrawal of your consent may result in the Pharmacy being unable to supply you with certain services , products or advantages or being obliged to stop supplying you with them; in such cases we will let you know of the consequences linked to the withdrawal of your consent so that you make an informed decision. Considering the printing and distribution schedules, it is possible that you continue receiving certain communications that were in process before receiving your request.

The Pharmacy will collect only necessary personal information for designated purposes and will collect it only through licit means
Collection of information over the telephone
We may monitor and/or record your telephone discussions with our representatives for our mutual protection to establish a record of the information you provide, to take or verify instructions from you, to maintain quality service levels and to assist in staff training. If you are not comfortable with having your telephone calls recorded, you will have, where possible, the option of communicating with us by other means.
4. Restricted Use, Disclosure and Retention
Personal information will not be used without your consent for purposes other than those for which it was collected.
The Pharmacy may communicate your personal information particularly as follows:
- with your consent;
- to independant service suppliers carefully chosen who provide us with services or provide them on our behalf and who have confirmed having safety and confidentiality standards similar to ours ;
- to help us proceed to collect a debt owed to us by you or to fulfill an obligation to us ;
- if it otherwise requires and permitted by law .
Personal information will be retained only for a period reasonably necessary for the fulfilment of the purposes for which it was collected or as required by law. All destruction or removal of personal information from our records is done securely with due regard to the sensitivity of the information concerned.
The Pharmacy will not sell or exchange or rent or lend your personal information to any organisation whatever aim it is.
5. Accuracy
The Pharmacy will do its best to ensure that personal information of persons is accurate, comprehensive and as up to date as necessary for the purpose for which it must be used but, we also rely on you to provide us with any change to your personal information particularly your contact information.
6. Protection Measures
To protect your personal information whatever the medium or format against loss, theft , unauthorized access, disclosure, copying, use or change of information, the Pharmacy may take security measures that are appropriate to the sensitivity of the information.
7. Transparency
The pharmacy offers information about its policies and practices related to the management of personal information, particularly the last version of the « Code of Protection of the Private Life » on our website www.luongleclerc.com .
8. Individual Access
When the Pharmacy receives your written request it will notify you, within a reasonable time, of the existence, use and disclosure of your personal information and will give you access to this information. The Pharmacy must verify your identity before giving the personal information that we have about you. If you tell us you suffer a disability, we will do our best to give you your personal information in a different form.
The Pharmacy might not be able to give you access to your personal information when this information cannot be released for security reasons or reasons linked to business secret, when this information is protected by privilege at law or if access is prohibited by law. If the Pharmacy cannot give you access , it will give you the reasons why the access was denied, except if the law prohibits to do so.
The Pharmacy may charge you reasonable fees to cover the cost for giving you the information. If there are fees the Pharmacy will inform you of the approximate cost of providing the information prior to processing your request and will provide you with the opportunity to withdraw your request.

9. Challenging Compliance
You may communicate with us to ask any question or to let us know of any complaint or suggestion concerning the respect of the privacy code by the Pharmacy. 10. Contests and websites
Note about contests
When a contest is held , sponsored or authorized by the Pharmacy , your personal information is collected, used and disclosed as follow:
- Concerning automatic participation contest for example, when doing a business transaction that gives you an automatic participation in a contest, your personal information is collected and used for the purpose of administering the contest.
- Concerning contests you choose to enter by giving your personal information, the personal information you provide us with by entering this contest is used only to administer this contest unless otherwise expressly stated in the contest rules.
- In some cases you may also request to receive information about us at the time you enter the contest, in which case your personal information may be used to supply you with the information you have requested or agreed to receive.
- Contest winners must also agree to the use of certain of their personal information such as their name, address, photograph in any publicity concerning the contest.

For contests sponsored and administered by a manufacturer ( whether or not jointly sponsored or authorized by the Pharmacy ) your personal information will be collected, used and disclosed in accordance with the information provided to you about the contest.
Notes about our websites
You do not have to give us personal information when you visit our websites, except to consult your personal information , if available. On the other hand, some identifying information can be automatically collected . We do not consider this information as personal information. For instance, our web server may collect the internet protocol ( IP ) address and the name of the internet service provider ( ISP ) associated with the computer by which you have reached our site, the type and version of web browser and computer operating system that you use and the address of the web site you visited prior to our site.
If your browser is set to accept cookies, some " session cookies " ( cookies that remain active only until you close your browser or until you manually delete the cookie using your browser software ) can be transmitted to your computer . A " cookie " is a bit of information automatically transmitted by our server to your browser to be stored on your hard drive which later lets our web server recover your data ( like your browser or your favorite language ) as anonymous information. It is possible that some sections of our website do not work if you do not accept the cookies.
